On October 17th, the Upper Niobrara White NRD received notice that the Department of Natural Resources (DNR) had released the 2008 Annual Evaluation of Availability of Hydrogically Connected Water Supplies Report. This report explains which river basins are considered fully appropriated.

DNR has preliminarily determined that the Niobrara River Basin between the Mirage Flats diversion dam in Dawes County and NPPD's Spencer Hydropower facility near Spencer is fully appropriated.
Effective October 27, there is a stay on the expansion of irrigated acres in the portions of sub-areas 2 and 3 that DNR determined to be fully appropriated (see map).
